On Wednesday,July 9, 2014 CMS Cameron McKenna in cooperation with U.S.-Ukraine Business Council held a workshop CRIMEA, DONBAS AND ARBITRATION: ISN’T THE FORCE MAJEUR OUR CONCERN?”. The event took place in SigmaBleyzer Kyiv office.

This event was dedicated to the problems of interpretation and implementation of the concepts of  force majeure, as well as of the material change in circumstances, as exception clauses in the situations of anti-terrorism operation in Donbas and Crimean annexation. 

Key Speaker at the workshop, Sergiy Gryshko delivered a comprehensive presentation to about 40 attendees. 

Issues  discussed:

  • Challenges of proving force majeure
  • Case law of international arbitration courts, including the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry concerning the force majeure
  • Analysis of circumstances, which cannot be regarded as force majeure.

Sergiy Gryshko - LL.M. (Queen Mary University of London), Senior Associate, Coordinator of Dispute Resolution practice

Sergiy joined CMS from Wilmer Cutler Pickering Hale and Dorr LLP in London. He specializes in Dispute Resolution holding an LL.M degree from Queen Mary University of London in International and Comparative Dispute Resolution. He combines the insight of civil service with the private practice experience. Sergiy is also the co-ordinator of the Dispute Resolution practice in Kyiv. Sergiy acted in a number of arbitrations conducted under ICAC, SCC, ICC and ICSID rules and has vast practice of various cases at all levels and branches of Ukrainian judiciary. Sergiy has acted on a number of occasions for foreign clients in enforcement proceedings before Ukrainian courts. Sergiy was recognised as the “notable practitioner” in International Arbitration by the Ukrainian Law Firms 2012, Top 50 Law Firms in Ukraine 2012, Yurydychna Praktyka. In 2012/2013 Sergiy was included in Top 250 Recommended Lawyers by Yurydychna Gazeta.
