| Liability for Violation of Legislation on Personal Data Protection is Postponed and Procedure for Processing of Personal Data is Adopted |
Ukrainian Legal Group LLC, Kyiv, Ukraine Legal Alert – 03 February 2012 Liability for Violation of Legislation on Personal Data Protection is Postponed and Procedure for Processing of Personal Data is Adopted Further to our Legal Alerts concerning legal regime for the personal data protection, we are pleased to inform you that 31 January 2012 a new Law was signed by the President, which postpones the liability for violations in the area of personal data protection for six month. The full name of this Law is the Law of Ukraine "On Amendments to the Final Provisions of the Law of Ukraine "On Amending Certain Legislative Acts of Ukraine regarding Enhancement of Responsibility for Violation of Legislation on Personal Data Protection" (the “Law”). The Law provides for delaying by six months (i.e. by 1 July 2012) the entry into force of administrative and criminal liability for violations of the laws on personal data protection by introducing relevant amendments to the Code of Administrative Offences of Ukraine and to the Criminal Code of Ukraine. In addition, on 3 January 2012 the Ministry of Justice of Ukraine registered the Order “On Approval of the Standard Procedure for Processing of Personal Data in Personal Data Bases”. The Standard Procedure was approved pursuant to the Law of Ukraine “On Personal Data Protection” and determines general requirements to organizational and technical measures of protection of personal data in the course of data processing in personal data bases. We consider these legal acts to be a positive development, giving business more detailed procedures on personal data circulation and additional time to switch to the new rules of personal data protection regulation.
