Steps towards decentralization: new rules approved for registering place of residence

On 2 March 2016, the Cabinet of Ministers of Ukraine adopted Resolution No. 207 (hereinafter - the "Resolution") by which the "Rules on Registration of the Place of Residence" and the "Procedure for Transfer of Information by Registration Bodies to the Unified State Demographic Register" were approved.
Rules on Registration of Place of Residence The new "Rules on Registration of the Place of Residence" (hereinafter - the "Rules") have set the procedure for registering the place of residence or place of stay of individuals in Ukraine, and the procedure for deregistering the place of residence or place of stay. Additionally, the templates of the documents necessary for registration or deregistration have been approved. From now on, local councils will carry out registration or deregistration of places of residence or places of stay within the territory of the administrative-territorial unit that is under the authority of the local council. Previously, such registration was carried out by the territorial unit of the State Migration Service of Ukraine (hereinafter - the "Migration Service"). The Rules establish a longer period within which a place of residence must be registered. A citizen of Ukraine, as well as a foreigner or a stateless person permanently residing in Ukraine must register the place of residence within 30 calendar days following deregistration at the previous address and arrival to the new place of residence. Previously, such period was only 10 days. Parents or other legal representatives of a newborn child must register the place of residence of the child within three months from the date of state registration of the birth. The Rules specify that only one place of residence can be registered (if a person has more than one place of residence). All legal notices must be sent to the registered address. Procedure for Transfer of Information by Registration Bodies to the Unified State Demographic Register The Procedure for Transfer of Information by Registration Bodies to the Unified State Demographic Register (hereinafter - the "Procedure") regulates the transfer of information on registration or deregistration of the place of residence or place of stay by the local councils to the Migration Service for further entry into the Unified State Demographic Register. Under the Procedure, such information is to be transferred to the Migration Service's information system on the same day when registration of the place of residence or of the place of stay is made.
