Sergiy Gryshko, Senior Associate and coordinator of the disputes resolution practice group in the Kyiv office of CMS Cameron McKenna delivered a presentation on “State-Entities and Veil Piercing: Seek or hide the assets” during recent conference Kiev Arbitration Days organized by Ukrainian Bar Association on 17-18 November 2011 in Radisson BLU Hotel.

During the presentation Sergiy spoke about reasons for enforcement of arbitral awards against foreign States and state entities, the primary being the availability of State-owned assets and restricted sovereign immunity from execution in certain jurisdictions. He also explained different approaches to jurisdiction of an enforcing court to determine who is the genuine award debtor in England, the USA and Canada. In particular, Sergiy described the difference between the Norsk Hydro, Bancec and TMR approaches as well as their effects and implications.

Kyiv Arbitration Days conference was dedicated to problems and prospects of international arbitration in Ukraine and worldwide. The event gathered together many arbitration practitioners from around the globe who shared their views and experience of modern international arbitration system.
