Monograph “Trademark: Complex Legal Analysis” by Senior Associate at Arzinger Law Office, Dr. iur. Natalia Ivanytska has been published. This monograph is aimed at research of different aspects of the legal regime of the trademark as object of exclusive intellectual property rights.    

Using the complex approach for illustration how a sign acquires a trade mark status N. Ivanytska considered the civil regulation regarding protectability of the individualization tool, procedures for registration of rights to a trademark under the national and Madrid  systems, features of a trademark as non-material assets of a tax payer.

The publication shows different contractual mechanisms for transfer of trademark rights and uncovers the complex system of remedies for trademark rights.

Author analyses the national and international legislation, the national and international court practice on the subject matter. Moreover, this work contains author’s general conclusions and recommendations based on Natalia Ivanytska’s professional experience by representation of interests in cases on protection of intellectual property rights.
